DSC Funds Online – Terms and Conditions

1. Terms of use

These are the terms of use on which you may make use of the Funds Online website as a registered user. Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using the site.

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. 

This site’s purpose is to provide information and advice on funding opportunities and other relevant forms of support for organisations and individuals, and to provide useful links between funders and applicants.

2. Intellectual property rights

The Directory of Social Change (DSC) is the owner or the licensee of all intellectual property rights in this site, and the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

All rights in information and materials on this site (the “Content”) belong to either DSC or its licensors. Some content may be downloaded from the site onto a computer, tablet, phone or similar device, and you may print individual pages on paper (but not on any server or other storage device connected to a network) for your personal, non-commercial use. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

Except as expressly set out above, you may not reproduce, modify or in any way commercially exploit any of the Content. In particular, but without limiting the general application of the restrictions contained in the preceding sentence, you may not do any of the following without special arrangement and prior written permission from DSC:

  • Redistribute any of the Content (including by using it as part of any library, archive or similar service)
  • Create a database in electronic or structural manual form by systematically downloading and storing all or any of the Content.
  • Allow or enable access to Funds Online in any way other than the terms of your specific subscription allows (see subscription types below)

In the event you wish to republish or redistribute Content in any manner, permission must have first been provided in writing by DSC.

3. Reliance on information published

Information and material published on this site is gathered from a range of sources and checked for accuracy. Although we endeavour to ensure that all published material is accurate, timely and updated regularly, DSC shall not be liable for any inaccuracies and/or omissions in any information or materials provided, nor any interruption or delay to the accessibility of the site. You should note that information and materials published or otherwise provided are for general information only and are not intended to be relied upon as specific advice or recommendations in relation to any transaction you may enter into or otherwise. DSC therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents. DSC shall not be liable in respect for any loss or damage including loss of profit, revenue or contracts or any consequential or special loss or damage arising.

4. Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy.

To the extent permitted by law, DSC and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
    • Loss of income or revenue
    • Loss of business
    • Loss of profits or contracts
    • Loss of anticipated savings
    • Loss of data
    • Loss of goodwill
    • Wasted management or office time; and
    • Any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

5. Information about you and your visits to the site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

We reserve the right to use data you provide in aggregate with other users’ data for research and marketing purposes. No data on individual users will be used without express consent from the user, for example in a case study or testimonial.

6. Uploading material to the site

Whenever you make use of a feature that allows you to upload material to our site, you must comply with the terms of use of this site. 

Any material uploaded to your profile must be done so with permission from the relevant copyright holder. We reserve the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property or other rights. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

We have the right to remove any material you upload to our site which we deem to be inappropriate.

7. Linking to our site

You may link to Funds Online, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. Our site must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only.  We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

8. Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.  These terms of use are governed by English law.

9. Privacy policy

We understand that you care how information about you is used and shared. This notice describes our privacy policy.

We take the privacy of our users seriously and will do everything we can to protect that privacy while providing a personalised and valuable service.

Gathering information about how the sector is using Funds Online is an important part of this website and we will under no circumstances sell it to others. We collect information about users who choose to register with our site to allow us to customise our services to their needs and to improve our overall service.

We use information in aggregate form (so that no individual user is identified) to build up search profiles, to provide feedback to information providers, and to audit usage of the site.

We may send you newsletters or information about our service and about relevant events. However, if you’d rather we didn’t, simply edit your profile and unselect the relevant communications.

We use cookies to identify you when you visit the Funds Online site and to build a profile of your interests. Our use of cookies allows registered users to be presented with a personalised version of the site. (A cookie is a small piece of information sent by a web server to a web browser, which enables the server to collect information back from the browser.)

This privacy policy only covers the Funds Online website at www.fundsonline.org.uk. Websites we link to from within this site are not covered by this policy.

10. Subscription types

10.1 – A Single User Subscription enables one user to access the specific data on the Funds Online site to which that subscription relates, and the features and functionality associated with that subscription. Upon receipt of payment the user will be issued with a username and password which they can use to log in to Funds Online. A Single User Subscription is for one user only and must not be shared with anyone else. Two or more users are unable to login concurrently with the same user details and attempts to do so are logged and monitored by DSC. Sharing login details may result in the termination of the subscription. If you require access for more than one person, you must purchase a Multi-User Subscription.

10.2 – A Multi-User Subscription is for a single organisation where two or more people will be using the site at any one time. One person will be the named account holder and be the point of contact for the subscription. Each user attached to the account will have his or her own login details and user profile. A Multi-User Subscription is for the agreed number of users within the same organisation only and will permit only the agreed number of users logged in concurrently. Attempts to exceed the maximum agreed number of users are logged and monitored by DSC – if you need to upgrade the number of licences please contact DSC and we will be happy to assist you.

A Multi-User Subscription will not permit access by more than one organisation unless expressly agreed in advance with DSC. Attempts to login concurrently on the same Multi-User Subscription across different organisations are logged and monitored by DSC. Sharing login details may result in the termination of your subscription.

Occasionally DSC may agree different subscription models with subscribers.

10.3 – Subscription Bands: the subscription rates for Funds Online vary depending on the type of organisation you are.

Registered Charity Rate: this is the rate payable by all charities registered with the Charity Commission (in England and Wales), the Office of the Scottish Charity Regulator or the Charity Commission for Northern Ireland. Upon subscribing you will be asked to provide your registration number which will be checked against the relevant register of charities.

Standard Rate: this is the rate payable by those organisations that are not eligible for the Registered Charity Rate, and includes Universities, Schools, Social enterprises, Local Authorities, private companies and sole traders, including fundraising consultants and other exempted charities.

11. Refund policy

If within one working day (24 hours) of logging onto Funds Online you notify us by electronic means that the product is not to your requirements, we will cancel your invoice or refund advance payment received. Cancellations will only be permitted after this time in the most exceptional circumstances upon electronic application to us and we shall have the discretion as to whether or not a credit note or refund can be made available, at which point our decision shall be final.

 

DSC is fully GDPR compliant as of 25 May 2018.

If you purchase products or services from us, we will process your data on a contractual basis. If we choose to contact you about related products and services that we think may be helpful to you, it will be on a legitimate interest basis.

You will be able to unsubscribe from marketing emails immediately via the unsubscribe link at the top of each email. If you receive a postal mailing, there will be clear instructions on the envelope.

Or, if you wish you can simply email us on cs@dsc.org.uk to be removed from all communications.

DSC uses information on Grant Making Charities to compile and produce core products such as The Directory of Grant Making Trusts and www.fundsonline.org.uk. Where data from the Charity Commission’s Register of Charities is used or reproduced, it is done so under the terms of the Open Government License 3.0 (http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/).

The privacy and credits sections of DSC’s Funds Online reads:

Information on DSC’s Funds Online includes data reproduced from the Register of Charities (https://www.gov.uk/find-charity-information) under the Open Government Licence 3.0 (http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/).

Where information relating to individuals (contact details or trustee names) is present in a funder’s entry, that information has been taken from either the Register of Charities, Companies House, the funder’s own published information, or from the funder themselves.

With regard to GDPR, the basis on which DSC processes that data is Legitimate Interest, with such information serving only to provide a complete profile of each funder, and the means by which they may be contacted with requests for funding.

The purpose of Funds Online is to provide information and advice on funding opportunities and other relevant forms of support for voluntary sector organisations and individuals, and to provide useful links between funders and applicants. It is the responsibility of the user to determine the legal basis for any subsequent processing of this information.
